This Privacy Policy is incorporated into and is part of the Terms of Use, and describes the types of information we may collect from you or that you may provide when you visit the website or install or otherwise use our mobile applications or interact with any  content, functionality, and services offered on or through the website or mobile application (collectively, the “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. Capitalized terms not defined herein shall have the meaning set forth in the Terms of Use.

This policy applies to information we collect:

  1. On the Services.
  2. In email, text, and other electronic messages between you and the Services.
  3. Through mobile and desktop applications you download from the Services, which provide dedicated non-browser-based interaction between you and the Services.
  4. When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

  1. Us offline or through any other means, including on any other website or mobile application operated by Company or any third party (including any of our affiliates and subsidiaries); or

Regardless of where our servers are located, your personal data may be processed by us in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world. Children Under the Age of 18  

Our Services are not intended for children under 18 years of age. No one under age 18 may provide any information on or to the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Services or provide any information about yourself to us, including without limitation your name, address (residential and business), zip code, telephone number, email address, date of birth, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It  

We collect several types of information from and about visitors to our Services, including information:

  2. your place of work, if you receive access to the app through your employer;
  3. that is about you but individually does not identify you, such as your current emotional state, your desired emotional state, and your current activity (e.g. Workflow, Winding Down); and/or
  4. about your internet connection or mobile device, the equipment you use to access our Services and usage details.

  1. Directly from you when you provide it to us.
  2. Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  3. From third parties, for example, your employer, our business partners, or third party service providers, including without limitation those servicing the Third-Party Accounts.

The information we collect on or through our Services may also include:

  1. Information, including your name, phone number, mailing address, billing address, company name, credit card or other payment information that you provide by making transaction or filling in forms on our Services. We may also ask you for information when you report a problem with our Services.

  3. Your responses to surveys that we might ask you to complete for research purposes.
  4. Your search queries on the Services.
  5. Information from other companies or Third-Party Accounts, such as when you sync a Third-Party Account or other service with the Services.

Information We Collect Through Automatic Data Collection Technologies As you navigate through and interact with our Services, we may use automatic data collection and user engagement technologies to collect certain information about your equipment, browsing actions, and patterns, including:

We may utilize cookies and other automatic data collection technologies, such as, web beacons (also known as “clear gifs” and “pixel tags”) to recognize you, customize your experience, and provide advertisements. While you may disable the usage of cookies through your browser settings, we do not change our practices in response to a “Do Not Track” signal in the HTTP header from your browser or mobile application. We track your activities if you click on advertisements for our services on third party platforms such as search engines and social networks, and may use analytics to track what you do in response to those advertisements. Cookies are small files placed on your computer, and they allow us to count the number of visitors to the Services and distinguish repeat visitors from new visitors. They also allow us to save user preferences and track User trends.  We do not link cookies or web beacons to any personal information. Advertisers and ad servers may use cookies and/or web beacons to monitor information related to advertisements. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by us and does not cover the use of cookies by any advertisers. Most web browsers automatically accept cookies, but you do not have to accept them. To disable cookies, you should access the “help” tab on your browser or read the information that came with your browser software.

We use or may use services such Apple Session Tracking and Google Analytics to help us understand how you find and interact with our Services. We never share any information we obtain from Google Analytics with any third parties for advertising or any other purpose unless compelled to do so by valid legal process.  You may be able to opt-out of Google’s collection. We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Third Party Integration

Our Services may contain links and provide integrations to other websites and the products and services of third parties, such as third-party service providers associated with your Third-Party Accounts. We provide these links and integrations as a convenience to you; we do not operate, control or endorse any third party. It is your choice whether to utilize these links and integrations or not. These external websites, applications, and products are subject to their own privacy policies.  To sync the Services with Third-Party Accounts, we must access your online account with the service providers (such as Facebook or Sonos and others) who service those accounts.  We will request your user name, password, and any other login data that you have associated with the Third-Party Account to enable access.  We use this information to update and maintain the account information you download, to assist with the download process, and to enhance the Services we may provide in the future.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  1. To present our Services and its contents to you.
  2. To provide you with information, products, or services that you request from us.
  3. To fulfill any other purpose for which you provide it.

  2. Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own products or services, you can opt-out via the “unsubscribe” button on emails or by selecting to not receive notifications in the “settings” section of the mobile application.
  3. We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Your California Privacy Rights  

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. California Civil Code Section § 1798.83 may permits users of our Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Security  

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Any payment transactions will be encrypted using SSL technology.

Unfortunately, the transmission of information via the internet or mobile devices is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Changes to Our Privacy Policy  

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Services login or home page. If we make material changes to how we treat our users’ personal information, we will notify you by email or through a notice on the Services home page. The date the privacy policy was last revised is identified at the top of the page.
